  • UNCONDITIONAL GUARANTY OF PAYMENT AND PERFORMANCE

    THE UNDERSIGNED “GUARANTOR”(s), as consideration for the present or future extension of credit by ILOCA SERVICES, INC. (“ILOCA”) to (“CUSTOMER”/Company Name), does hereby unconditionally guarantee the prompt payment and performance of all obligations owed by CUSTOMER to ILOCA. GUARANTOR hereby expressly acknowledges that there are no conditions precedent to the effectiveness or enforcement of this Guaranty, and that GUARANTOR is jointly and severally liable along with CUSTOMER to ILOCA by virtue of the terms hereof as primary obligors and debtors.

  • MAINTENANCE GUIDELINES FOR STANDARD LEASES

    --Mileage Charges Apply--

    When you select the mileage lease, ILoca will perform the maintenance required for normal tire and brake replacement and items related to normal wear. Any damaged items will be the responsibility of the customer.

    CUSTOMER RESPONSIBILITY:

    Tires: Maintain air pressure of 95 PSI on radials. Check on a daily basis. Repair flats, replace flat run tires, and replace tires damaged by road hazards or driver mistakes such as curbed tires, flat run or cuts. Replace blown out tires and return to ILoca for evaluation. No credit will be given for shredded tires. Normal tire wear is 1/32” tire tread depth, per 10,000 miles, per tire on tandem axle; 8,000 miles, per tire on spread axle. Any wear beyond that is considered excessive wear and will be billed at $42.00 per 1/32” tire depth, per tire.

    Lights: Replace burned out bulbs, broken light assemblies, and lost lenses and reflectors.

    Brakes: Adjust brakes as needed and repair damage to air system. Notify ILoca at 3/8” brake lining to schedule brake replacement and/or replace before lining reaches 2/8”. Additional charge may apply if lining reaches 2/8”. Normal wear is 1/8” brake lining depth per 20,000 miles, per shoe. Any wear beyond that is considered excessive wear and will be billed at $42.00 per 1/8” brake lining depth, per shoe.

    Other: Daily safety inspections and maintenance of proper oil or grease levels on axles, braking system components and landing gear. Maintain proper inflation of tires, proper brake operation and operable lighting. Replacement cost of lost or stolen licenses plates.

    ILOCA RESPONSIBILITY:

    Tires: Replace normally worn tires at 4/32” tread depth at ILoca facility. Premature wear will be billed to customer. If done at customer’s location, travel time will be billable.

    Replace failed tires covered by manufacturer’s warranty. ILoca will not pay for road calls. ILoca will credit customer any tire credit issued to ILoca by a tire company.

    Lights: Repair shorts or defective wiring.

    Brakes: Replace normally worn brake pads at ILoca facility.

    Repair or replace air chambers and brake valves at ILoca facility.

    Other: Perform regularly scheduled preventive maintenance at ILoca Trailer Rental facility.

    Please note that all service work is to be completed at an ILoca facility. If work is performed elsewhere, the customer is responsible for the charges. ILoca may pay for all, part or none of the repair expenses. Any repair bills are to be submitted for reimbursement must include trailer number, hub reading, and a detailed description of services performed. If tire work is done, the invoice must include tire position (ie: LIF tire). All repair bills must be submitted within 5 business days from the date of repair for approval. Repair invoices are NOT to be deducted from account balance or invoices. The customer will receive approved/denied claim from ILoca. If approved, you will receive a credit applied to your account.   • MAINTENANCE GUIDELINES FOR NET/NET LEASES --No Mileage Charges-- When you select the NET/NET lease, the lessee assumes responsibility for performing the required maintenance on the trailer and all items needing repair on the trailer. CUSTOMER RESPONSIBILITY: Tires: Replace normally worn tires. Maintain air pressure of 95 PSI on radial tires. Repair flats. Replace flat run tires. Replace tires damaged by road hazards or driver mistakes such as curb tires or cuts. If original (virgin) tires on trailer, when replacing, replace with like. Lights: Replace burned out bulbs. Replace broken light assembly. Replace lost lenses and reflectors. Repair shorts or defective wiring. Brakes: Replace normally worn brake pads. Repair air chambers and brake valves. Adjust brakes as needed. Repair damage to air system. Other: Daily safety inspections and maintenance of proper oil or grease levels on axles, braking system components and landing gear. Maintain proper inflation of tires, proper brake operation and operable lighting. Replacement cost of lost or stolen licenses plates. ILOCA RESPONSIBILITY: Licensing: Provide base plate licensing. Trailers: Well maintained FHWA inspected equipment at lease inception.

  • NET/NET AGREEMENT In connection with certain lease agreement(s), covering certain items of equipment, between ILoca Services, Inc. as “lessor” and
  • as “lessee”, it is agreed that upon execution by the parties hereto, this lease addendum shall constitute a part of said lease. This agreement covers all rental units on net/net leases to lessee. The length of the lease(s) will be identified on each individual lease. Lessee authorizes individual drivers to sign the lease for lessee when picking up and returning equipment. Maintenance Addendum Lessee agrees, at its sole cost and expense, in addition to, and not in limitation of all of its duties and obligations set forth in the lease, to: a) Keep all equipment during the life of the lease in first-class working order and efficient operating condition, b) Subject to the provisions of the lease, replace any substantially worn or broken parts with new manufacturer made or manufacturer approved parts, including tires, tubes, and brakes, and c) To perform daily safety inspections, unless otherwise provided by foreign or United States Federal authority, ordinance, decree or law, maintain proper hub oil and grease levels, proper inflation of tires, proper brake operation, including adjustments and operable lighting, and including replacement of lenses and bulbs, if required. Upon completion of use, all equipment shall be returned to the location directed by ILoca Services, Inc. Equipment shall be returned in the same condition as the “outbound” condition, or lessee agrees to pay the lessor for parts and labor to restore equipment to its original outbound condition. Tire Provision Tires must be returned in the same condition and at the same tread levels as when the lease(s) started, or lessee agrees to pay to the lessor the deficiency in said tire tread levels. Tread depth will be inspected and gauged by 1/32nd inches by an ILoca Services, Inc. representative at the time of the outbound inspection. A similar inspection will be performed and the results thereof designated on the “inbound” inspection report. The lessee will then be liable for a charge calculated at the rate of $42.00 per 1/32nd inch of tire tread depth (per tire) for radial tires based on the difference between outbound and inbound tread depth designated at the time lessor takes possession of the equipment pursuant to the lease. If tires were original (virgin) when the lessee took possession of equipment, then the equipment needs to be returned with original (virgin) tires (meaning no recapped or regrooved tires). This can either be new or used virgin tires depending on the outbound level of tires at initial lease inception. If the tires are returned as recapped or regrooved, a charge for an original (virgin) tire replacement, including installation, will apply. Brake Provision Brake levels must be returned at the same levels as when the lease(s) started, or lessee agrees to pay to the lessor the deficiency in said brake lining levels. Brake lining level will be gauged by 1/8th inch by an ILoca Services, Inc. representative at the time of the “outbound” inspection. The lessee will then be liable for a charge calculated at the rate of $42.00 per 1/8th inch of brake lining (per wheel) based on the difference in outgoing and incoming brake lining levels designated at the time lessor takes possession of the equipment pursuant to the lease.

  • STANDARD REEFER MAINTENANCE GUIDELINES --Reefer Hour Charges Apply-- ILoca strives to make sure you have peace of mind that your load is delivered with uninterrupted temperature control. In order to supply you with the best equipment, ILoca requires some due diligence on the part of the customer. Together, with our preventative maintenance program, ILoca is Your Partner for the Long Haul. When you rent or lease a refrigerated trailer, the reefer hour charge includes: Periodic scheduled preventative maintenance on reefer units every 3,000 hours, with interim inspections at every 1,500 hours. Inspections are to be performed in accordance with manufacturer’s recommended guidelines at an ILoca Services, Inc. branch during normal business hours, Monday-Friday. CUSTOMER RESPONSIBILITY: Fuel: Maintain proper fuel levels to prevent the reefer from running out of fuel. Lack of fuel will cause damage to the reefer. Fluids: Maintain proper oil, coolant, and refrigerant levels. Electrical: Visually inspect electrical lines and assure that connections are water tight. Maintain a proper battery voltage. Other: Schedule preventative maintenance on reefer units in accordance with manufacturer’s recommended guidelines. Provide proof of service every 6 months or 1500 hours, whichever comes first. ILOCA RESPONSIBILITY: PM: Replace normally worn items at an ILoca Services branch. Premature wear will be billed to customer. If done at customer’s location, travel time will be billable. Preventative maintenance on reefer units is to be done in accordance with manufacturer’s recommended guidelines at an ILoca Services branch. Compressor: Replace worn seals, bearings, bushings, etc as needed. Premature wear will be billed to customer. Electrical: Repair shorts or defective wiring due to manufacture failure. Repair defective display screen due to manufacture failure. Belts: Replace normally worn belts. Premature wear will be billed to customer. Other: Perform regularly scheduled preventive maintenance at ILoca Trailer Rental facility. Please note that all service work is to be completed at an ILoca facility. If work is performed elsewhere, the customer is responsible for the charges. All work is to be performed at a factory authorized location. If the work is performed elsewhere, the repair must be inspected by ILoca or a factory authorized location for proper repair within 5 days. ILoca may pay for all, part or none of the repair expenses. Any repair bills are to be submitted for reimbursement must include trailer number, hub reading, and a detailed description of services performed. All repair bills must be submitted within 5 business days from the date of repair for approval. Repair invoices are NOT to be deducted from account balance or invoices. The customer will receive an approved or denied claim from ILoca. If approved, you will receive a credit applied to your account.
